Terms of Service
The agreement that governs your use of Webscepts domains, web hosting, VPS, dedicated servers, email and related services.
These Terms of Service ("Terms") form a binding agreement between you ("Customer", "you") and Webscepts Solutions (Pvt) Ltd ("Webscepts", "we", "us"), a company registered in Sri Lanka. They apply to every product and service we provide, including domain registration, shared, business and WordPress hosting, cloud and VPS servers, dedicated servers, business email, SSL certificates, software licences, migrations and technical support (together, the "Services").
By creating an account, placing an order, or using any of the Services, you confirm that you have read and accept these Terms, our Privacy Policy and our Acceptable Use Policy. If you are accepting on behalf of a business, you confirm that you have authority to bind that business.
1. Eligibility & Your Account
You must be at least 18 years old, or the age of legal majority where you live, to order Services. You agree to provide accurate, current and complete information when you register and to keep it up to date, in particular your name, postal address, email address and phone number.
- You are responsible for keeping your client area, control panel, server and email passwords confidential, and for all activity that takes place under your account.
- Notify us immediately at info@webscepts.com if you suspect any unauthorised access to your account.
- We may ask you to verify your identity or payment details before activating, transferring or changing a Service. Orders that fail verification, or that we reasonably believe to be fraudulent, may be cancelled.
- Accounts are personal to the registered holder. Ownership of an account can only be transferred with our written approval.
2. Ordering & Provisioning of Services
Each Service is provided according to the plan specification shown at the time of your order (for example disk space, bandwidth, CPU, RAM, mailbox count or number of websites). Most Services are provisioned automatically once payment clears; some (such as dedicated servers, custom configurations and .lk domains) may require manual review and can take longer.
We may upgrade hardware, software, control panels, PHP versions, data centres and network providers from time to time to keep the platform secure and performant. Where a change materially reduces the features of your plan, we will give you reasonable advance notice.
3. Billing, Renewals & Late Payment
Prices are shown in Sri Lankan Rupees (LKR) or US Dollars (USD) and are exclusive of any applicable taxes unless stated otherwise. Services are billed in advance for the billing cycle you select (monthly, quarterly, annually or multi-year).
- Services renew automatically at the end of each billing cycle at the renewal price displayed in your client area. Introductory or promotional prices apply to the first term only unless the offer says otherwise.
- Invoices are issued before the due date. If payment is not received by the due date, the Service may be suspended; services left unpaid for 14 days after suspension may be terminated and their data permanently deleted.
- Domain names that are not renewed before expiry may enter a registry grace or redemption period, during which additional restoration fees set by the registry apply. We cannot guarantee that an expired domain can be recovered.
- Chargebacks or payment disputes raised without first contacting our billing team may lead to immediate suspension of all Services on the account until the matter is resolved.
- We may change our prices with at least 30 days' notice. New prices apply from your next renewal.
4. Cancellations & Refunds
You may cancel a Service at any time from your client area. Cancellation takes effect at the end of the current billing cycle, or immediately if you request it; in either case, data stored on the Service will be removed once it ends.
- Where a plan is advertised with a money-back guarantee, you may request a refund of that plan's hosting fee within the stated guarantee period.
- Domain registrations, renewals and transfers, SSL certificates, software licences (such as cPanel, Plesk or Windows), setup fees, migration services and dedicated server orders are non-refundable once processed, because their costs are paid to third parties immediately.
- Refunds are not available for accounts suspended or terminated for breach of these Terms or the Acceptable Use Policy.
- Approved refunds are returned to the original payment method or credited to your account balance.
5. Uptime Guarantee & Service Credits
We target 99.99% monthly network and hardware uptime for shared, business, WordPress, cloud and VPS hosting. Uptime is measured by our monitoring systems and excludes downtime caused by scheduled maintenance announced in advance, emergency security patching, your own code, configuration or content, abuse or attacks directed at your Service, suspension under these Terms, and events outside our reasonable control.
If uptime falls below the guarantee in a calendar month, you may request a service credit by opening a support ticket within 7 days of the end of that month. Credits are applied to future invoices for the affected Service only, cannot be exchanged for cash, and in any month are capped at the monthly fee for that Service. Service credits are your sole remedy for downtime.
6. Resource Usage & "Unlimited" Plans
Shared hosting environments are used by many customers, so every account must use resources fairly. Plans described as "unlimited" or "unmetered" (for example bandwidth or databases) are provided for the normal operation of a personal or business website, and are not intended for file storage, backups of other systems, media streaming, file sharing or data archiving.
- Each account is subject to CPU, memory, process, I/O and inode limits set out in the plan or in our knowledge base.
- If an account consistently affects the stability or performance of a server, we may throttle it, temporarily restrict it, or ask you to upgrade to a more suitable plan such as a VPS or dedicated server.
- We will contact you before taking action wherever practical, but may act immediately to protect other customers.
7. Backups & Your Data
Where your plan includes automated backups, we make reasonable efforts to keep them, but they are provided as a convenience and are not guaranteed to be complete, current or restorable. Unmanaged VPS and dedicated servers are not backed up unless you purchase a backup add-on.
You remain solely responsible for keeping your own independent, off-site copies of all website files, databases and email. We are not liable for any loss or corruption of data, however caused.
8. Your Responsibilities
- Keep your websites, content management systems, plugins, themes and scripts updated and secure.
- Ensure that all content you host or transmit is lawful and complies with our Acceptable Use Policy.
- Hold all licences and rights needed for the software, images, media and other content you upload.
- On VPS and dedicated servers with root or administrator access, you are responsible for system administration, security hardening, firewall configuration and software licensing unless you have purchased a managed plan.
- Comply with all laws that apply to your use of the Services, including data protection, consumer protection and e-commerce laws.
9. Domain Name Registrations
We act as a reseller or agent for accredited registrars and registries. Your registration is also subject to the policies of the relevant registry and of ICANN, including the Uniform Domain-Name Dispute-Resolution Policy (UDRP), and for .lk domains, the policies of the LK Domain Registry.
- You must provide accurate registrant (WHOIS) contact details. Inaccurate details may cause a domain to be suspended or cancelled by the registry.
- Registration is on a first-come, first-served basis. A domain is not registered until the registry confirms it, and an order does not guarantee availability.
- You are responsible for ensuring that your domain name does not infringe any trademark or other third-party right.
- Domains remain registered in your name. You may transfer a domain away at any time, subject to registry rules, provided it is not within a lock period and all outstanding invoices are paid.
10. Support & Migrations
Technical support is available 24/7 through support tickets, live chat and phone for matters relating to the Services we provide. Support for third-party software, website development, code debugging or server administration on unmanaged servers is outside the scope of standard support and may be offered as a paid service.
Free website migrations are offered on a best-effort basis for supported control panels. You should keep your existing hosting active until you have confirmed that the migrated site works correctly.
11. Suspension & Termination
We may suspend or terminate any Service, with or without notice, if you breach these Terms or the Acceptable Use Policy, fail to pay amounts due, provide false information, or if your use creates a security risk, legal liability or harm to us, our network or other customers. Where possible, we will give you notice and an opportunity to correct the issue first.
On termination, your right to use the Service ends and we may permanently delete all data associated with it. Any amounts owed remain payable.
12. Intellectual Property
You retain all rights in the content you upload to the Services. You grant us a limited licence to host, copy, transmit and back up that content solely as needed to provide the Services. The Webscepts name, logo, website, software and documentation remain our property or that of our licensors, and may not be used without our written permission.
13. Disclaimers & Limitation of Liability
Except as expressly stated in these Terms, the Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose or uninterrupted, error-free operation.
To the maximum extent permitted by law, Webscepts will not be liable for any indirect, incidental, special or consequential loss, including loss of profits, revenue, business, goodwill or data. Our total liability for any claim arising from the Services is limited to the amount you paid us for the affected Service in the three (3) months before the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited by law.
14. Indemnity
You agree to indemnify and hold harmless Webscepts, its directors, employees and partners from any claims, losses, damages, fines and reasonable legal costs arising from your content, your use of the Services, or your breach of these Terms, the Acceptable Use Policy or any law.
15. Force Majeure
We are not responsible for any failure or delay caused by events beyond our reasonable control, including natural disasters, power or telecommunications failures, upstream network outages, large-scale cyber attacks, acts of government, civil unrest, war or pandemics.
16. Changes to These Terms
We may update these Terms from time to time. The "last revised" date at the top of this page shows when they last changed. For material changes we will notify you by email or through your client area at least 14 days before they take effect. Continuing to use the Services after that date means you accept the updated Terms.
17. Governing Law & Disputes
These Terms are governed by the laws of the Democratic Socialist Republic of Sri Lanka. We encourage you to contact us first so that we can try to resolve any concern informally. If a dispute cannot be resolved within 30 days, it will be subject to the exclusive jurisdiction of the courts of Colombo, Sri Lanka.
If any part of these Terms is found to be unenforceable, the rest remains in effect. Our failure to enforce any provision is not a waiver of our right to do so later.
